Terms and Conditions of Returns and Withdrawal from the Contract

1. Right of withdrawal from the contract

Pursuant to the Act of 30 May 2014 on Consumer Rights (hereinafter: “the Act”), a Customer who is a Consumer and who entered into a distance contract (e.g. via an online store) has the right to withdraw from it without giving any reason within 14 days of receiving the shipment.

To meet the deadline, it is sufficient to send the statement before its expiry. An Entrepreneur (a person running a business) does not have a statutory right to withdraw from the contract under this procedure, unless the store’s terms and conditions provide otherwise (which is not envisaged in this case).

2. Deadline for returning the goods

In the event of withdrawal from the contract, the Customer is obliged to return the goods immediately, but no later than within 14 days of withdrawal from the contract.

To meet the deadline, it is sufficient to send the shipment at a post office or via a courier.

4. Return costs

The costs of returning the goods shall be borne by the Customer.

NOTE: The Customer may not return the goods cash on delivery (so-called “postal COD”).

5. Condition for accepting the return (Condition of the product)

The Customer is liable for any diminished value of the item resulting from using it in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the item.

  • Permitted (scope of “normal inspection”): You may do with the product as much as in a stationary store – inspecting the product.
  • Not permitted (results in a deduction): Using the product, damaging the individual packaging.

The Store has the right to refuse the return or deduct the diminished value (compensation) if the product shows signs of use.

6. Exceptions to the right of return (When return is not possible)

Pursuant to Art. 38 of the Act, the right of withdrawal from the contract does not apply to the Customer, inter alia, in the case of:

  1. Goods with custom specifications: Products manufactured according to the Customer’s specifications or serving to meet individualised needs (e.g. personalised prints, engraved goods).
  2. Hygienic and intimate goods: Items delivered in sealed packaging that cannot be returned after opening for health protection or hygiene reasons, if the packaging has been opened (e.g. in-ear headphones, underwear, swimsuits, mattresses, intimate products).
  3. Data carriers: Sound recordings (CDs, vinyl records) or visual recordings (DVDs, games) delivered in sealed packaging, if the packaging has been opened.
  4. Perishable goods (e.g. food, flowers).

7. Refund

The Store shall refund to the Customer all payments made by them (including the cost of delivery – the cheapest available option) immediately, no later than within 14 calendar days of receiving the statement of withdrawal from the contract.
The Store may withhold the refund until it has received the goods back or until the Customer has supplied proof of returning them (whichever occurs first).

8. Liability for the return shipment

The goods must be returned to the address given in §3. The risk of accidental loss or damage to the goods during return passes to the Store upon delivery of the shipment. Until delivery, the risk is borne by the Customer, therefore we recommend sending with confirmation (registered mail/courier).
